139 music rights agency or designated agent (e.g. Harry Fox
140 Agency), royalties for any phonorecord You create from the
141 Work ("cover version") and distribute, subject to the
142 compulsory license created by 17 USC Section 115 of the US
143 Copyright Act (or the equivalent in other jurisdictions), if
144 Your distribution of such cover version is primarily intended
145 for or directed toward commercial advantage or private
146 monetary compensation.
147 e. Webcasting Rights and Statutory Royalties. For the avoidance of
148 doubt, where the Work is a sound recording, Licensor reserves the
149 exclusive right to collect, whether individually or via a
150 performance-rights society (e.g. SoundExchange), royalties for the
151 public digital performance (e.g. webcast) of the Work, subject to
152 the compulsory license created by 17 USC Section 114 of the US
153 Copyright Act (or the equivalent in other jurisdictions), if Your
